The following agreement is signed by the Employer and the Employee:
Employer
Gigapay Sweden AB, corporate no. 559070-3616 ( https://app.gigapay.se/login ). Address: Brunnsgränd 4, 111 30 Stockholm, Sweden.
Self-Employed Worker
The Employee's name, social security number and contact information as shown in their personal account on the Employer's website.
Form Of Employment
The form of employment is a special fixed-term employment as per Section 5 of the Swedish Employment Protection Act (”LAS”). The employment is directly tied to the duration of the assignment, which must always be specified for each individual case, but for a maximum of 30 days at a time. If a new assignment period begins, a new special fixed-term employment begins.
Position/Professional Title
The Employee is self-employed. The Employee undertakes tasks defined by external clients (the "Client"). The Employee's position and tasks vary depending on the assignment they undertake. Tasks are stated in the assignment’s instructions, which are obtained from the Client and adapted to the applicable position.
Working Hours
As defined in the assignment instructions. Working hours must be determined in accordance with the Employer's General Terms and Conditions and mandatory law.
Place Of Work
The place of work varies depending on the assignment and the position specified in the assignment description.
Time-Limited Form Of Employment
The applicable form of employment is a special fixed-term employment according to section 5 of LAS. Employment is valid from when the Employee undertakes an assignment up to the last day of employment, which coincides with the last day of the assignment in question. The employment is terminated without prior notice.
The Employer has the right to immediately terminate the agreement with the Employee if they violate the fixed-term employment agreement or the Employer's General Terms and Conditions.
Salary
The assignment is procured and performed by the Employer and invoiced to the Employer by the Employer. The amount invoiced for the assignment is converted into salary and paid to the Employee according to the Employer's General Terms and Conditions. The salary payment takes place when the Employee logs in to the Employer's website and approves the conditions for the payment.
Vacation
The Employee is, in accordance to Semesterlagen § 5, not entitled to vacation leave during the employment. However, the Employee is entitled to compensation for the vacation of twelve percent (12%) of paid out salary, which is included in the salary amount announced on the Employer’s website.
Pension
The Employee receives statutory pension benefits.
Insurance
The Employee is covered by an accident insurance during his employment with the Employer. It is the responsibility of the Employee to verify that sufficient and correct insurance is in place for the performance of a particular assignment. The Employee is also covered by a liability insurance during his employment with the Employer. The liability insurance is subject to restrictions regarding i.a. the scope of responsibility and excludes certain professional groups. The limitations appear in the Employer's General Terms and Conditions. In order to be covered by the insurance, the Employee must be healthy, have completed a health examination if necessary, and have notified their assignment in advance.
Disease
In the unfortunate event of getting sick, or otherwise physically or mentally in-apt to work, the Employee may be entitled to sick pay according to the Sick Pay Act (Swedish: Lag (1991:1047) om sjuklön), provided that some requirements are met. The Employer’s responsibility as an employer is to comply with the sick pay act and pay out compensation in the event of illness as prescribed by the law. If the Employee is sick, they must immediately report their absence to the Employer.
Overtime And Overtime Work
The Employee is not entitled to compensation for overtime/overtime work, travel time and inconvenient working hours.
General Terms Of Employment
The Employee undertakes to comply with what is stated in the Employer's policies, general terms and conditions and other instructions that may be updated from time to time. The Employee declares that they understand that the general terms of employment are unilaterally decided by the Employer and that it is up to the Employee to keep up to date with what the Employer announces in this regard.
Other Benefits And Comments
The Employee is self-employed. Employment is only valid if the Employee has been approved and registered by the Employer and the Employee has undertaken an assignment through the Employer. When the Employee commits to an assignment through the Employer, the Employee formally enters into a fixed-term employment. Any activity that is not directly linked to such assignment is not covered by the employment.
Personal Data
By signing this agreement, the Employee agrees that the Employer registers personal data for the purpose of administering the employment relationship and related purposes in accordance with the legislation in force at any time and the Employer's Privacy Policy.
Appendix To Fixed-Time Employment Agreements For The Self-Employed
In addition to this Agreement, the Employer's General Terms and Conditions and Privacy Policy apply.
Signatures
The fixed-term employment agreement for Employees using the employer of record Service is considered to have been automatically signed at the point when the Employee is registered on the Employer’s website and has approved the employment agreement. The fixed-term employment agreement then applies each time the Employee undertakes a new assignment through the Employer.
